In order to establish a claim, an injured person in Massachusetts must prove four things:
- That there was a doctor/patient (or other health care provider/patient) relationship with the injured person;
- That there is a standard of care with regard to the proper treatment of such a patient;
- That the health care provider deviated (or fell below) the standard of care in his/her treatment of the patient; and
- That the patient was harmed as a result of the poor care.
